Nello scritto si esamina il percorso giurisprudenziale che ha portato a qualificare l’«ambiente» in senso giuridico ora come «bene immateriale», ora come «bene materiale», illustrando le ragioni alla base dei due diversi orientamenti. Si propone di rileggere retrospettivamente il dibattito, anche alla luce del nuovo quadro costituzionale derivato dalla novella dell’art. 9 Cost., assumendo la distinzione tra ambiente in senso lato (riferibile ai sistemi socio-ecologici, in cui l’ambiente è inteso come sistema di relazioni e interazioni tra fattori ecologici, sociali ed economici) ed ambiente in senso stretto (riferibile ai soli sistemi ecologici). Si valuta in che modo la dialettica tra immaterialità e materialità possa declinarsi rispetto alle nozioni, ormai giuridicizzate, di «ecosistema» e di «servizi ecosistemici». Dall’analisi emerge, conclusivamente, un’ipotesi di lavoro: immaterialità e materialità coesistono all’interno della fisionomia giuridica delle categorie giusambientali, in un rapporto di complementarità. ***** The paper focuses on the jurisprudential path that has led to the classification of the “environment” in legal terms as either an “intangible asset” or a “tangible asset”, showing the reasons behind the two different approaches. It proposes a retrospective re-reading of the debate, also in light of the new constitutional framework resulting from the amendment to Article 9 of the Italian Constitution, assuming the distinction between the environment in a broad sense (referring to social-ecological systems, in which the environment is understood as a system of relationships and interactions between ecological, social and economic factors) and the environment in a narrow sense (referring only to ecological systems). It is assessed whether the dialectic between immateriality and materiality can be applied to the now legalised notions of “ecosystem” and “ecosystem services”. The analysis ultimately leads to a working hypothesis: immateriality and materiality coexist within the legal structure of environmental law categories, in a relationship of complementarity.
