The essay deals with Procul. 7 ep. D. 23.3.67: in this fragment, an epistula attributed to the jurist Proculus, the case of a woman slave is examined who, still being a slave, transfers ‘as a dowry’ her own partner money. The question submitted to the jurist concerned the possibility of considering the money transfer valid where the slave had been freed and then validly married the recipient of the pecunia. Proculus – in the interpretation here given of the passage – explored the actions available to the primary owner of the money to recover it. In parallel, the testimonies of Ulp. 33 ad ed. D. 23.3.39 pr., Ulp. 31 ad Sab. D. 41.9.1, e di Marcell. 7 dig. D. 23.3.59.2 are considerated.
