The recent ruling of the European Court of Justice in the Star Taxi case offers food for thougth on the need to ensure fair and equitable competition between traditional operators and the new players providing services through digital platforms and applications. This paper shows why a modernization of the EU law on the freedom to provide information society services in the internal market is urgently needed in order to guarantee a level playing field and which legal principles, conceived in a wholly different economic and technological context, are now, in the digital era, obsolete.

Abstract
